Agreement
These Terms of Use (“Terms”) are a contract between you and DigiPaw Studios LLC (“DigiPaw,” “we,” “us”) covering the DigiPaw mobile application, the digipawstudios.com website and related services (together, the “Service”). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you download DigiPaw from Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these Terms with the right to enforce them. Apple has no obligation to provide maintenance or support for the app.
What DigiPaw is
DigiPaw is a care log for one dog in one household. It records meals, potty, water, walks and other care, sends reminders you set, and shows trends. It also includes a stylized game companion and light games that respond to logged care.
DigiPaw is not a veterinary service. Nothing in the app is medical advice or a diagnosis. The companion pup’s mood, trends and reminders are tools for remembering routines, not indicators of your dog’s health. Always consult a licensed veterinarian about your dog’s health, and seek emergency care when needed.
Accounts and Family Hub
- You must be at least 18 years old (or the age of majority where you live) to create an account or make purchases.
- You are responsible for the accuracy of your sign-in details and for activity under your account.
- A Family Hub is for one household and one dog. Invite only people you trust to see and log your dog’s care. The person who creates a Hub can remove members.
- Children may use the app only as a nickname on an adult’s phone, under that adult’s supervision.
Purchases and subscriptions
- DigiPaw Plus is an auto-renewing subscription purchased through the App Store or Google Play. Prices are shown in the app before you buy and may vary by region.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- Treats (such as Recall, Zoomies and Pet Sitter) are one-time consumable purchases used inside the app’s games. They have no cash value and cannot be transferred.
- Refunds are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through their stores.
- Use “Restore purchases” in Settings to recover purchases on a new device signed into the same store account.
Acceptable use
You agree not to: reverse engineer, copy or resell the Service; interfere with its security or other users’ Hubs; use it to harass anyone; upload content that is unlawful or that you have no right to share; or use automated tools to access the Service.
Your content
You own the logs, notes and photos you create. You give us a limited license to store and process them only as needed to run the Service for you and your household. Photos stay on your device and are not uploaded to us.
Our property
The DigiPaw name, logo, companion artwork, sounds, software and design are owned by DigiPaw Studios LLC and protected by copyright and trademark law. We grant you a personal, non-transferable, revocable license to use the app on devices you own or control, as allowed by the app store you got it from.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose. Reminders depend on your device’s settings, battery management and network; we cannot guarantee that every notification arrives on time, and you remain responsible for your dog’s care.
Limitation of liability
To the fullest extent permitted by law, DigiPaw Studios LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or 50 US dollars. Some jurisdictions do not allow these limits, so they may not apply to you.
Termination
You can stop using DigiPaw at any time and delete your account by following the steps on our Support page. We may suspend or end access to the Service if you break these Terms. Sections that by their nature should survive, such as ownership, disclaimers and limitation of liability, survive termination.
Governing law and changes
These Terms are governed by the laws of the United States and the state in which DigiPaw Studios LLC is organized, without regard to conflict-of-law rules. We may update these Terms; if the change is material we will notify you in the app before it takes effect. Continued use after that date means you accept the new Terms.
